We will process the categories of your personal data set out int the Annex for the following purposes:

  1. to fulfill your orders;
  2. for the performance of our contract with you;
  3. to manage our customer relations, including the analysis of customers’ business needs and how they use our products and services
  4. to further optimize and develop our website;
  5. to create usage statistics;
  6. to be able to recognize, prevent and investigate attacks.

We collect this data from you either automatically when you visit our website meryts-management.com or upon your provision as set out in Annex A.

You are under no obligation to provide us with the data we ask you for. However, if you do not provide your personal data, you will not be able to make use of all the functions of our website and the performance of our contract may be impossible.

Should the provision of your personal data be mandatory by law, we will inform you separately thereof.

  1. Legal bases of the processing

 

We process the categories of your personal data listed in the Annex A either on the basis of:

  • the performance of the contract we have concluded with you or the necessity to take steps at your request prior to entering into such an agreement, insofar as it is necessary (Article 6(1)(b) General Data Protection Regulation (“GDPR”)), or
  • our overriding legitimate interest according to Article 6(1)(f) GDPR to achieve the purposes set out in point 1 lit c) to f) above, or
  • the necessity to comply with legal obligations to which we are subject (Article 6(1)(c) GDPR).
  1. Transfer of your personal data

 

To achieve the purposes set out above, we will transfer your personal data to the following categories of recipients:

  • IT service providers that we use;
  • distributors, logistic companies and postal service providers that we use;
  • Payment Service Providers;
  • Providers of services requested by you, such as concert and event organizers
  • cooperation partners, such as travel agencies and yacht brokers
  • tax and legal advisors

Some of the recipients referred to above are located in or process personal data outside of your country. The level of data protection in another country may not be equivalent to that in your country.

However, we (i) either transfer your personal data only to countries where the EU Commission has decided that they have an adequate level of data protection, (ii) take measures to ensure that all recipients provide an adequate level of data protection (for example, by entering into appropriate data transfer agreements based on Standard Contractual Clauses (2010/87/EC and/or 2004/915/EC)) or (iii) in case those two options are not available the data transfer is strictly restricted to transfers which are inevitable to perform our services.

  1. Retention period

We will retain your data collected during the visit of our website for a period of three months.

The data you have provided to us upon our engagement will be retained for a period of 3 years after the end of our contract.

We will only retain your data for a longer period (i) to the extent that this is necessary to investigate attacks on our website or (ii) as long as required under statutory retention obligations or (iii) as long as potential legal claims are not yet time-barred, where personal data is needed to raise or defend against the claim.
